Lumatic Terms of Service
Effective date: October 31, 2026 (updated October 31, 2026)
These Terms are an agreement between you ("Customer") and Transport King LLC dba Lumatic, a California limited liability company ("Lumatic," "we," "us"). By signing up for or using Lumatic or trylumatic.com, you agree to these Terms on behalf of yourself and your business. If you do not agree, do not use the service.
1. The service
Lumatic provides automated messaging for US service businesses:
- Lite ($99/month): self-serve plan with unlimited texts (see Section 1A). Lite includes missed-call text-back, after-hours replies and a weekly "jobs saved" report.
- Starter ($149/month): unlimited texts (see Section 1A) and missed-call text-back. When a call to your business goes unanswered and is forwarded to a Lumatic number, our system automatically sends a text to the caller, and notifies you of the missed call. Starter also includes after-hours replies, Google review requests to your customers after each job, a weekly "jobs saved" report, and a shared lead list of callers and texts.
- Pro ($199/month): everything in Starter, plus automated lead and estimate follow-up, appointment reminders, and win-back texts to your past customers.
Texts are sent automatically by software on your behalf. They are not written or sent individually by a person at the time they go out. You approve the message wording. Features and plans may change with notice. Setup usually takes 1 to 3 weeks because carriers must register text messaging, and we email you your date. Timing is an estimate, not a guarantee.
1A. Fair use of unlimited texts
Every plan includes unlimited texts for normal business use. That means the automated texts that go out in response to your own customers' inbound missed calls and lead inquiries. As a guide to normal use, we expect about 1,500 texts a month on Lite, 3,000 on Starter and 5,000 on Pro. These numbers are a guide, not a limit. If your usage goes over the guide for two months in a row, we will contact you to talk about upgrading or what fits you best. There is no automatic cutoff and no automatic overage charge. Unlimited does not cover bulk or marketing blasts, texts to purchased or scraped lists, or any use unrelated to your own inbound missed-call and lead traffic. We may still limit or stop messages that we reasonably believe are spam, abuse, or a violation of the law or carrier rules (see Sections 5, 6 and 10).
2. Your account
You must be at least 18, authorized to bind your business, and operate in the United States. Keep your account information accurate and secure. You are responsible for activity under your account.
3. Call forwarding and your phone service
You keep your own phone number and phone carrier. Unanswered calls are forwarded to a Lumatic number using your carrier's call-forwarding feature. Your carrier may charge for forwarding or have limits. Lumatic is not responsible for your carrier's service, charges or settings. Texts are sent from a Lumatic number, not from your own number. Lumatic is not an emergency or 911 service; do not rely on it for urgent or emergency communications.
4. Fees and billing
- Month-to-month. Plans renew monthly until canceled, counting from the day texting goes live. You may cancel; cancellation takes effect at the end of the paid month. We do not prorate partial months.
- When you are charged, and when your month starts. You are charged when you sign up. Your first billing month, your next bill date and your 30-day money-back window all start on the day texting goes live for your business. We email you that date. The go-live date depends on carrier approval, so it is an estimate, not a guarantee. If texting never goes live for your business, or you cancel before it does, we refund the full amount you paid.
- Founding first-month price. The first 10 customers to start a paid Lumatic subscription (as determined by our records; the same founding members as in the price lock below) are founding members. Founding members pay $49 for Lite, $75 for Starter or $99 for Pro for month 1, then their plan price (Lite $99, Starter $149 or Pro $199 per month) is locked for as long as their subscription stays active, as set out in the founding-member price lock below. The first-month price and the price lock apply together. The first-month price is charged when you sign up, as your first monthly charge. It covers your first billing month, which starts on the day texting goes live (see above), and it is the amount refunded under the money-back guarantee below. It is not a free trial, and it applies once per customer, only to that first monthly charge. Once the 10th founding customer has signed up, the offer ends and the regular plan price applies to every later sign-up. A refund or cancellation does not free up a founding spot. The first-month price does not carry over to a later sign-up.
- No setup fee. Lumatic does not charge a setup fee. The only exception is the carrier registration fee described below.
- Carrier registration fees if you cancel early. If you cancel within the first 3 months after texting goes live, we may bill you the actual one-time carrier texting-registration fees we paid on your behalf. We bill them at cost, with no markup, and only once.
- First-month money-back guarantee. If you are not happy within 30 days of the day texting goes live for your business, email hello@trylumatic.com within that period and we will refund your first month's fee (the founding price if it applied to you: $49 for Lite, $75 for Starter or $99 for Pro; otherwise $99 for Lite, $149 for Starter or $199 for Pro). The guarantee covers your first month's plan fee only. It does not cover later months, taxes or third-party carrier charges. It is a refund of fees, not a promise of results (see Section 10), and it is available once per customer.
- Prices exclude taxes, if any. Carrier and registration pass-through charges, if any, will be disclosed before they are charged.
- We may change prices with at least 30 days' notice; the change applies at your next renewal, except as described in the founding-member price lock below.
- Founding-member price lock. The first 10 customers to start a paid Lumatic subscription (as determined by our records) are founding members. A founding member keeps the monthly plan price in effect when they signed up (Lite $99/month, Starter $149/month or Pro $199/month) for as long as their subscription stays continuously active. The price lock applies to the plan price only, not to taxes or third-party charges. The founding first-month price above applies in addition to this price lock: the locked price is the plan price, which applies from month 2. If you cancel, or your subscription ends or lapses for any reason, the price lock ends and any later sign-up is at the then-current price. The lock is not transferable. We may still add or change features and may change the plan name or structure, but we will not raise a locked founding member's monthly price for the plan they hold while their subscription remains active.
- Unpaid fees may lead to suspension of the service.
5. Your responsibility for consent and compliance
You are responsible for how you use Lumatic. You must comply with all laws that apply to calls and texts, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act where relevant, state "mini-TCPA" laws (such as those of Florida, Oklahoma and Maryland), carrier rules, and CTIA guidelines.
In particular:
- Replies to a caller who contacted you (missed-call text-back) should be limited to responding to that inquiry.
- Marketing, promotional or ongoing follow-up messages may require the recipient's prior express written consent. You are responsible for obtaining and keeping proof of that consent before you ask us to send those messages. Lumatic does not collect that consent for you unless we expressly agree in writing.
- You must not upload or send messages to contacts who have not consented where consent is required, or who have opted out.
- Every message must clearly identify your business and honor opt-out requests. Lumatic will process STOP and similar opt-out words automatically and respond to HELP; you must not override an opt-out.
- You are responsible for message content you approve and for complying with laws in each state where recipients are located.
Lumatic does not provide legal advice. You should consult your own attorney about your obligations.
6. Quiet hours and frequency limits
To help meet legal and carrier rules, Lumatic may delay, limit or block messages. Currently, by default:
- Quiet hours: no marketing-type or follow-up texts before 8:00 a.m. or after 8:00 p.m. in the recipient's local time (stricter state rules may apply).
- Frequency caps: for recipients in states with texting-frequency limits (for example Florida, Oklahoma and Maryland, which restrict the number of marketing messages in a 24-hour period and set stricter time windows), we may cap messages and apply earlier cut-off times.
We may change these limits at any time to follow the law. Delayed or blocked messages do not entitle you to a refund, apart from the money-back guarantee in Section 4.
7. Carrier and third-party terms
Message delivery depends on mobile carriers and other providers. Carriers may filter, block, delay or fine messaging, and their rules can change. You agree to follow the messaging provider and carrier requirements we pass along to you (including registration requirements), and you are responsible for any carrier fines or penalties caused by your content, your lists or your failure to follow these Terms. We do not guarantee delivery of any message. Message and data rates may apply to recipients.
8. Acceptable use
You may not use Lumatic to:
- send spam, unsolicited messages, or messages without required consent;
- send unlawful, deceptive, harassing, threatening, or abusive content;
- send content about illegal drugs, firearms, adult content, gambling, "SHAFT" content, or high-risk financial offers such as payday loans or debt collection, or any category prohibited by carriers;
- impersonate others or hide your identity;
- send messages to purchased or scraped lists;
- interfere with, reverse-engineer or overload the service; or
- violate any law or third party's rights.
We may suspend or end service immediately for a violation or for a carrier or legal demand.
9. Your data and our privacy practices
You own your business data. You give us permission to use it to provide the service. Our handling of personal information is described in our Privacy Policy. You promise you have the right to give us the contact information you provide. Text messages with callers are stored so you can see them.
10. No guaranteed results; disclaimer
Lumatic is provided "as is" and "as available." Any examples of revenue or job value are illustrations only, not promises. We do not guarantee any number of leads, bookings, jobs, revenue or response rates, or that the service will be uninterrupted or error-free. To the maximum extent allowed by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Limitation of liability
To the maximum extent allowed by law:
- Lumatic will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost jobs, lost revenue or lost business, even if advised of the possibility.
- Our total liability for all claims relating to the service will not exceed the fees you paid us in the 3 months before the claim arose.
- Lumatic is not liable for carrier outages, call-forwarding failures, or messages delayed, filtered or not delivered.
Some places do not allow these limits, so some may not apply to you.
12. Indemnity
You will defend and reimburse Lumatic for claims, losses, fines and costs (including reasonable attorneys' fees) arising from your content, your lack of required consent, your violation of law or these Terms, or your misuse of the service.
13. Term and termination
You may cancel as described in Section 4. We may suspend or terminate service for non-payment, violation of these Terms, legal or carrier requirements, or if we stop offering the service (with a refund of any prepaid, unused monthly fees if we end the service without cause). Sections that by nature should survive will survive termination.
14. Changes to these Terms
We may update these Terms. We will post the new version with a new effective date and notify you by email of material changes. Continued use after the change means you accept it.
15. Governing law and disputes
These Terms are governed by California law, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Orange County, California, and you consent to that venue.
16. General
These Terms and the Privacy Policy are the entire agreement between us. If a provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in a business transfer. Our failure to enforce a right is not a waiver.
